August 9, 2004

Krans, Jake & Bridgette – Cronk Road Map 10, Lot 44A
The hearing convened at 6:00 p.m. Applicant constructed a deck on his single-family dwelling without proper permits. The Commission reviewed the documents presented by Mr. Krans and issued a letter to the Building Commissioner approving the project from the Commission’s standpoint. The Commission treated the project as an amendment to the Determination of Applicability issued to the Krans’ in January 2004. The hearing convened at 6:20 p.m.
Howitt, C. Linda – 20 Beartown Mountain Road Map 6, Lot 20
NOI – 230-218
The hearing commenced at 6:22 p.m., (continued from July, 2004). Richard Andrus, abutter, recused himself from the proceedings. Representing Ms. Howitt was Dan Akroyd of Greylock Design, Inc. Mr. Akroyd presented new plans showing a new location for the single family dwelling that takes it completely out of the riparian zone and bordering vegetated wetlands. The Commission asked that new plans be presented with a signature and stamp affixed thereto. Mr. Akroyd informed the Commission that the leaching field will be redesigned and relocated, and all activities will be performed outside the riparian zone and 50’ setback to the bordering vegetated wetlands. The Order of Conditions will be issued at such time as the Board of Health issues the septic permit. It was further
indicated that any clearing within the 50’ setback to BVW be limited to retaining 50% of the existing canopy due to the maturity of the existing trees. The following conditions were imposed: 1) New plan for soil absorption system be submitted to the Commission within 21 days of the date of the 8/9/04 hearing; 2) New plans shall be submitted with the engineer’s stamp and signature affixed thereto; 3) Plan showing depiction of: relationship of on- site buffer zone area and area proposed to be cleared. The hearing convened at 6:42 p.m.
Berkshire Natural Resources Council
NOI: 230-224 - Hiking Project – Main Road Map 13, Lots 5 & 7
Emily Stockman, Stockman Associates (soil scientist) and Tad Ames, BNRC were present to discuss the project. The Commission reviewed the plans, discussed the paving of the apron and gravel for the parking area. It was indicated the trail head would begin at the end of the parking area. The Commission asked that boards be laid overtop the existing boardwalk area in need of repair, and stated that portion of the project was a limited project. The Commission has asked BNRC to provide the following: 1) location of the silt fencing on the plans; 2) sketch showing the slowdown and filter of flow from the parking area. The Commission imposed conditions as follows:
1) The placement of the silt fence shall be installed per drawing
2) All disturbed areas shall be seeded and mulched
3) The Project Manager (Chris Blair) shall be notified at least 48 hours prior to commencement of the project. The Hearing adjourned at 7:26 p.m.
Sutton, Charles – Beartown Mountain Road Map 4, Lot 15B
NOI 230-223 – Construction of a gravel driveway to access single-family dwelling
The Hearing convened at 7:40 p.m. The Suttons were represented by White Engineering, Inc. Applicant wishes to construct a gravel driveway to access a single-family dwelling site. A portion of the driveway is within the riverfront area and will cross bordering vegetated wetlands. The Commission asked that swales be installed along the driveway to divert water into the Town’s drainage system. The Commission further asked the Engineer to have rip rap installed due to the steep grade. This installation would help slow down any sediment. The Hearing was continued to September 13, 2004, or until such time as details are received on the driveway swales and a driveway permit is issued by the Town’s issuing authority. A letter was written to Mr. Sutton asking him to
install hay bales in order to avoid erosion. The hearing was continued to the August 9, 2004 Meeting, and adjourned at 8:20 p.m.
Knoll, Philip – 35 Stevens Lake Road Map 3, Lot 92A
RDA – tree removal
Determination: N3
Meeting convened at 8:20 p.m. The Commission issued a negative decision for the removal of 55 trees (corrected from the original plan of 23 trees). The Commission imposed the following conditions: 1) Applicant to provide an approval letter for the work from Stevens Lake Assn.; 2) There shall be no excavation of stumps, and stumps shall be removed through a grinding process only; 3) all disturbed areas shall be hayed. The Meeting adjourned at 8:35 p.m.
Cash, Phyllis – 13 Buckingham Lane Map15, Lot 186
RDA – expansion of existing deck
Determination: N3
Meeting convened at 8:35 p.m. The Commission reviewed the plans of Phyllis Cash and approved same with the following conditions: 1) hay bales shall be placed as indicated on submitted plans; 2) any and all excavation shall be performed by hand; 3) all excavated soils shall be stored off site or between the existing house and Buckingham Lane.
Meeting adjourned at 8:45 p.m.
Stucker, Virgil – Gould Road Map 7, Lot 59
David Anderson, Builder, was present to request the Commission’s sign-off on the Stucker Building Permit Application. After review of the presented site plan, the Commission determined the project was over 400’ from the Konkopot River and, therefore, out of the 200’ riparian zone. The Commission signed off on the application.
The Hearing was adjourned at 9:15 p.m.
